Agastya - Chauffeur Service (Agastya), its related Operators, and Licensees are not common carriers and may refuse to transport any person(s) without providing a reason. Agastya and each Operator and Licensee are responsible for the services they provide and are not liable for any other services.
It is the hirer's responsibility to carefully read the FULL TERMS & CONDITIONS before confirming a booking, as this signifies that you accept and are bound by them.
Subject to the terms, Agastya, its Operators and Licensees, have no responsibility for costs or losses including missed flights or travel connections, resulting from diversion, substitution, alterations, cancellations, delay’s or booking errors. It is the hirer’s responsibility to advise of any changes as full costs may be incurred.
Passengers must comply with all laws and regulations in the state they are travelling and with the instructions of Agastya its Operators and Licensees.
Except as otherwise provided by these terms, and to the extent permitted by law: (a) Agastya, its Operators and Licensees, are not liable for death of or injury to any person, for loss or damage to luggage or goods, for delay’s, or for consequential or other loss of any kind, arising directly or indirectly from negligence or omission or some other cause in connection with provision or non-provision of any services and (b) Is not liable for inaccuracy in any information concerning transport services or its prices.
Amendments
After confirmation, modifications to your reservation may only be approved based on availability. If you need to make changes to your booking, Agastya, its Operators, and Licensees reserve the right to impose additional fees on top of any other relevant fees.

Credit Card surcharge
Credit card surcharges may apply at the discretion of the local Customer Service Centre at which the service has taken place.
Credit Card Transaction
If the customer uses a credit card to pay for the transportation or service, they agree to pay the whole amount due when they receive their bill or in instalments according to the credit card issuer's regular policies.
Customer Safety
Our drivers will always drive sensibly and safely, taking into account traffic, the speed limit, and the state of the roads. They also reserve the right to refuse entry to any location that they believe could endanger the safety of the passengers and the vehicle.
Damage to Vehicle and Inappropriate Behaviour
The hirer assumes responsibility for any damages caused to the vehicle during the service, including stains, scratches, or interior damage, with charges assessed accordingly. Inappropriate behaviour towards chauffeurs, staff such as verbal abuse or intoxication, will result in immediate termination of service, with no refunds provided.
While we prioritize safety and security, we cannot be held liable for any loss, damage, or injury incurred during our service, and hirer agree to indemnify us against any claims arising from their use of services provided by Agastya.
Extensions
The hirer is responsible for any charges levied by Agastya, its Operators or Licensees, in respect of extra time in the event that changes are made to the original booking either by the booker or passenger. This includes any extra charges levied where you choose to extend the duration of your booking and/or add additional stops to the original booking.
Extra Charges
In the event of extra charges or extensions (as described above), the passenger must immediately pay the extra amount to the chauffeur, either before or after the transfer. Additional charges may be charged back to your Agastya account or credit card if this was used to secure the booking initially.
Insurance
Agastya, its Operators, and Licensees are insured for passenger travel. This insurance is for public liability, NOT travel insurance. Although we will make every attempt to keep personal goods safe, we cannot take liability for loss or damage to personal items. Please ensure that you have enough coverage for any personal belongings brought on-board our cars.
Lost & Found
Agastya, its Operators, and Licensees will not be liable for any lost or misplaced personal property. If a customer leaves personal belongings in the vehicle, Agastya's Operators and Licensees will make every effort to return the items to the customer at their expense, or the item(s) can be recovered from our Customer Service Centre.
Luggage Information
Our sedan’s maximum luggage limitations are two (2) normal-sized suitcases (check-in size for a plane) plus two (2) pieces of hand luggage/soft luggage (carry-on for a plane) or one (1) large suitcase plus one (1) set of Golf Clubs and one (1) soft luggage.
If a customer has additional luggage than a sedan can hold, they should think about scheduling a larger vehicle, like a People Mover with a trailer. For safety reasons and transportation regulations, no suitcases will be carried within the vehicle's passenger cabin.
Additional Pickup/Set Down
Additional charges will apply for all extra pickup/set downs required en-route unless already quoted.
On Time
Please be assured that Agastya, its Operators and Licensees, will take every reasonable safeguard to achieve an on-time service, however in the unlikely event of our chauffeurs being late due to circumstances howsoever caused, no liability will be accepted by Agastya its Operators and Licensees.
Pets
Pets are not permitted in the vehicles, with the exception of “guide or hearing dogs’’ and a blanket/mat must be provided by the passenger travelling.
Seat Belts
Under Australian laws, it is compulsory that all passengers wear seat belts were fitted at all times when the vehicle is in motion.
Smoking
Smoking is not permitted by state law in any Agastya vehicle. Charges will apply, at the discretion of the chauffeur or Agastya, if any passenger is found to be smoking in any Agastya, or Agastya service-providers’ vehicle.
Special Event Bookings
Either full payment or a deposit is required for Special Occasions such as, but not limited to, Weddings, School Formals, Sporting Events and Concerts. If a deposit has been made, full payment is required either prior to or at the conclusion of the event. Surcharges may apply to such events.
Credit card details are required to secure all bookings.
Subcontracting
Agastya, its Operators and Licensees, reserve the right to use the services of other approved hire car/limousine/bus service providers as required. These operators have been pre-qualified by Agastya and deemed to be of a sufficient quality to provide services on Agastya’ behalf. These providers, for the duration of the booking, remain under the supervision of Agastya, its Operators and Licensees, at all times.
Limits of Liability & Insurance
If accepted, the maximum responsibility will be capped by the trip's refund. Although great care will be taken, no responsibility will be accepted. There will be no assumption of consequential loss or liquidated damages, or any other fees.
Exclusions
If Agastya, its Operators, and its Licensees breach this contract, Agastya, its Operators, and its Licensees shall have no duty whatsoever to the Customer for any indirect loss and/or expense (including loss of profit) incurred by the Customer.
Cancellation Policy
Cancellation charges will apply when:
- Cancellations are made with less than 24 hours’ notice prior to the dispatch of the vehicle for all bookings excluding Flexi Cancellation opted bookings.
- Cancellations are made with less than 1 hours’ notice for all bookings including Flexi Cancellation.
- Bookings where the passengers fail to arrive or make contact with the chauffeur or the Agastya Customer Service Centre.
- Stricter cancellation policies may apply to any of the above, however will be advised to you at the time of booking and will supersede the above policies.
Special Cancellation Policy applies for Weddings and Events.
As Directed or Hourly Booking Cancellation Terms:
- Full charges will apply when cancelling a Mini-bus or a Bus/Coach booking within 24 hours from the scheduled pick-up time.
- Full charges will apply when cancelling a Sedan, SUV or a People Mover booking less than 12 hours prior to the scheduled pick-up time.
- 50% charge applies when cancelling a Sedan, SUV or a People Mover booking between 12 hours and 24 hours prior to the scheduled pick-up time.
Please note that the above terms and conditions are subject to change and are binding upon acceptance of our services. By engaging our services, you agree to comply with these terms and conditions.
Flexi Cancellation
- Flexi cancellation option allows customers to cancel their booking free of charge up to 1 hour before the scheduled pick-up time.
- Cancellations can be made via phone, e-mail, or through our online booking portal.
- Flexi cancellation policy is subject to change at our discretion.
Waiting Time
Agastya offers well above industry-standard complimentary waiting time for all bookings.
Complimentary waiting time is applied as follows:
- 15 minutes of complimentary waiting time at homes, motels, or other non-airport pickup locations.
- Domestic airport terminals offer 30 minutes of complimentary waiting time.
- International airport terminals offer a complimentary 1 hour wait time.
- There is a 45-minute complimentary waiting period at cruise ship terminals.
Waiting time is charged in 5-minute increments once any complimentary waiting time has been exhausted.
Below waiting time rates include GST.
Waiting time rates apply to ALL Agastya accounts, as well as individual bookings via the Agastya website, unless otherwise specified on your individual rate sheets and/or contracts.
Following the complimentary waiting period, waiting time is charged in 5-minute increments, and you can view the rates here.

*All flights are tracked via radar and complimentary waiting times only begins from the moment the plane lands, regardless of any flight delays.
After Hours Surcharges
A 25% Surcharge applies for all vehicle type bookings that begin between 22:00 and 04:59hrs.
*Certain contracts or rate schedules may contain different terms to those listed above. The terms contained within valid and current contracts and/or rate schedules will supersede the above terms with respect to After Hour Surcharges.
Public Holidays
Some surcharges may apply on public holidays, check with the Customer Service Centre when making bookings.
Typically, surcharges will be incurred on Christmas Day and New Years Eve / New Years Day in most cities. Surcharges do not often apply in most major cities during other public holidays.
Child Restraints
As Agastya is a pre-booked service, unlike taxi services, there is a legal obligation that there is enough notice to install a child restraint.
Therefore, according to Australian law, all children under the age of eight must be positioned in a baby capsule, baby seat, or booster seat. that when traveling with us, any child under the age of eight must always be seated in a child seat.
For baby capsules, baby seats, and booster seats, there is a basic $30 relocation and fitting cost per booking—not per seat.
Parents and caregivers are strongly recommended to check child restraints before the trip begins and make necessary adjustments, even though chauffeurs will take every precaution to install them safely. Child restraint installation is a skill that chauffeurs possess. The parent or caregiver of the child should be ensuring their child's safety, just like they would in their own automobile, as they aren't certified fitters.
Trailers
A $30 fee will be charged for the supply of trailers attached to appropriate vehicles.
If you are travelling with a lot of luggage, please discuss this with our reservations team to ensure the appropriate vehicle and trailer is allocated to your transfer.
If a vehicle and trailer arrive and your luggage does not fit, and the capacity was not discussed prior, you will be required to book an additional taxi service to move all remaining luggage at your own cost.
Agastya is not liable for additional charges relating to luggage capacity being exceeded.
Trailers cannot be fitted to the below vehicle types:
- Sedans
- SUVs

The Privacy Policy relates to the collection and use of personal information you may provide to us through your contact on the website. Your continued use of our website and its facilities constitutes your acceptance of the terms and conditions. Agastya believes the information on the website is correct. Agastya disclaims all liability and responsibility for any direct or indirect loss or damage which may be suffered by any recipient relying on anything contained in or omitted from our website or publication.
Use of Personal Information
Your personal information is used for the hiring of Agastya services and used for that purpose alone. By entering the Agastya secure website booking facility, you understand that all information provided by you is your sole responsibility and Agastya accepts no responsibility for any incorrect information provided in respect to the hiring made through this facility. It is not given to a third party except where the purpose relates to fulfilling the obligations of your hiring. Your personal information may be retained for use in future bookings. If at any time you believe the information is incorrect, you may contact us to have it corrected.
Credit Card details are stored securely for the purpose as outlined in our terms and conditions of hire. Agastya staff its Operators and Licensees are obliged under the Confidentiality Deed to keep personal information secure.
Disclosure
Agastya may be obliged to surrender your personal information to regulatory authorities and law enforcement officials in accordance with the applicable law. Personal information may also be disclosed to identify, contact, or bring legal action against anyone damaging, injuring, or interfering with our rights or property.
Data Retention & Privacy Policy
At Agastya Transport we comply with the Privacy Act 1988 (Cth) (Privacy Act) This Policy explains how we manage the personal information that we collect, hold, use, and disclose and how to contact us if you have any further queries.
This Privacy Policy applies to you only to the extent that the collection and handling of your personal information by Agastya is subject to the Privacy Act.

Your concern or complaint will be directed to the appropriate complaint manager who will consider and respond to your complaint within 7 days.
It is our intention to use our best endeavours to resolve any complaint to your satisfaction. However, if you are unhappy with our response, you may contact the Office of the Australian Information Commissioner who may investigate your complaint further.
